Two civilians convicted in federal magistrate court Published April 2, 2014 By Capt. Megan Schmid 71st Flying Training Wing Staff Judge Advocate office VANCE AIR FORCE BASE, Okla. -- Two civilians who committed crimes on Vance Air Force Base in 2013 were convicted and sentenced in federal magistrate court on March 25. One was convicted of driving while under the influence of alcohol. He was sentenced to 12 months of probation, a $1,000 fine, a $100 mandatory contribution to the Oklahoma Alcohol and Drug Treatment Revolving Fund, a $25 special assessment and 90 days in-home detention -- commonly referred to as "house arrest." His probation includes several restrictions such as no consuming alcohol, no frequenting bars or clubs where the primary business is the sale of alcohol and submitting to random urinalysis to detect alcohol use. The second civilian was convicted of assault and battery. He was sentenced to six months of probation, a $1,000 fine and a $25 special assessment. His probation also includes several restrictions such as a prohibition on possessing firearms. Civilians, including reservists not on active duty orders, receive Department of Defense Form 1805s for criminal offenses committed on Vance AFB. For example, a civilian pulled over for speeding will receive a DD Form 1805. This citation may have a monetary penalty assigned to the traffic offense as dictated by Oklahoma State law. It can also include points or penalties attached to the individual's driving record as dictated by Oklahoma State law. A person receiving a DD Form 1805 has the right to request a court appearance. If this option is chosen, or if the citation violator has committed a "must appear" offense, they will be seen by a federal magistrate judge in Oklahoma City.
